Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Puff AI ("Company," "we," "us," or "our"), concerning your access to and use of the Puff AI mobile application and any related websites, media forms, channels, or connected services (collectively, the "App").

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE APP.

We reserve the right to modify these Terms at any time, at our sole discretion. We will notify you of any changes by updating the "Last Updated" date of these Terms. It is your responsibility to review these Terms periodically. By continuing to use the App after updates, you agree to the revised Terms.

The App is intended for users who are at least 13 years old. If you are under the age of 18, you must have permission from a parent or guardian to use the App, and they must review and agree to these Terms on your behalf.

Intellectual Property Rights

The App, including its source code, software, functionality, design, text, graphics, images, and other content (collectively, the "Content"), as well as any trademarks, service marks, and logos (the "Marks") used or displayed within the App, are our proprietary property or licensed to us. All Content and Marks are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App and access its Content for your personal, non-commercial use. You may not copy, reproduce, distribute, publicly display, or create derivative works from the Content or Marks without our prior written permission.

User Representations

By using the App, you represent and warrant that:

  • You have the legal capacity to agree to and comply with these Terms.
  • You are at least 13 years old.
  • If you are under 18, you have obtained parental or guardian consent.
  • You will not access the App using automated tools, scripts, bots, or other non-human means.
  • You will not use the App for any illegal or unauthorized purpose.
  • Your use of the App complies with all applicable laws and regulations.

If you provide inaccurate or incomplete information, we reserve the right to suspend or terminate your access to the App.

Prohibited Activities

You agree not to use the App for any purpose other than its intended functionality. Specifically, you agree not to:

  • Systematically collect data or content from the App to create a database or directory.
  • Use the App for unauthorized commercial purposes.
  • Circumvent or interfere with the App's security features.
  • Use automated systems to access the App.
  • Engage in any activity that disrupts or interferes with the App's performance.
  • Attempt to reverse engineer or decompile the App's software.
  • Upload or transmit viruses or harmful code.
  • Harass, threaten, or intimidate other users or staff.
  • Misuse support services or submit false reports.

Disclaimer of Warranties

The App and its Content are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be error-free, secure, or available at all times.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, revenue, or profits, even if we have been advised of the possibility of such damages.
